These Terms and Conditions govern your use of the Talent Scan website and App (together, "the Platform"). By registering on or using the Platform, you agree to be bound by these terms. Please also read our Privacy Policy, which forms part of your agreement with us.

| User(s) | Any person — including crew, accounts, agents or Talent — who makes use of the Talent Scan System. |
| Data | Any information stored on the Talent Scan digital or analogue databases. |
| Registrar | The person directly responsible for supplying data to Talent Scan for the registration of new data or the updating and amendment of existing data. |
| Agent / Agency | The company or person acting as an agent on behalf of any crew or Talent within the film and entertainment industries. |
| Runlist(s) | The list(s) of Talent compiled for a specific production day, used for roll call and as timesheets. |
| Talent Scan Film Industry ID Card | The RFID card created for Talent that registers with Talent Scan, used for identification and to scan and track Talent on the Talent Scan System. |
| Timestamp(s) | The time recorded and stored on the Talent Scan System. |
| Checkpoint | Any place, access point or area where the identity of any Talent is checked for the purposes of any Talent Scan procedure, including but not limited to: Pickup Areas, Roll Call, Breakfast, Costume, Makeup, Props, Armoury, Lunch, Medical, Wrap, Drop Off, Casting and Security Areas. |

1.1Talent Scan is not an Agent. Registration on the Platform enables data captured on the System to be used in combination with Talent Scan software and digital services only. Talent Scan shall not be responsible or held liable for any agency services, including but not limited to: procuring work for Talent, booking Talent on productions, invoicing, payments, profile updates or arranging photo shoots.
1.2Registration on the Platform does not guarantee work or booking on any production.
2.1To use the Platform, Users must register and create an account using accurate, truthful and current information. Talent Scan operates on the understanding that all data added to the System is accurate and will not be held liable for any inaccuracies provided by Users.
2.2Upon registration, a verification email will be sent to the email address provided. The account will be activated once the email address has been verified by clicking the link in that email. Talent Scan is not responsible for undelivered verification emails resulting from incorrect email addresses or spam filters.
2.3It is the responsibility of all Users and Talent to enquire about the procedure for accessing and managing their profile on the Platform.
2.4It is the responsibility of all Users and Talent to view their profile information regularly and to ensure that all data is correct and current, and to amend any data that is incorrect or has changed.
2.5Captured data is not the property of Talent Scan and will be removed on the request of the Registrar responsible for that data. If such data is subsequently re-registered by a different Registrar, it will be available on the System until that Registrar instructs its removal.
3.1The Talent Scan App is a Progressive Web App (PWA) accessible on mobile and desktop devices. By using the App, Users agree to these Terms and Conditions in full.
3.2The App may use your device's local storage and a service worker to enable offline functionality, including queuing check-in actions when connectivity is unavailable. These actions will be submitted to the Talent Scan System automatically when connectivity is restored. By using the App offline, Users confirm that any actions queued during offline use are accurate and authorised.
3.3Users must keep their login credentials confidential and must not share access to their account with any other person. Talent Scan will not be held responsible for any unauthorised access resulting from a User's failure to protect their credentials.
3.4Talent Scan reserves the right to suspend or terminate access to the App or Platform where a User is found to be in breach of these Terms and Conditions or where such access is otherwise deemed necessary to protect the integrity of the System.
4.1When making use of the Talent Scan System, all Users and Talent accept that any and all scanned timestamps are truthful and accurate as recorded in real time and that no other confirmation or approval of working times is required.
4.2In the case of any person not being in possession of a relevant Film Industry ID Card (or any other scanning material relevant to the Talent Scan System), a manual input of attendance at any Checkpoint will be done by a crew member via the Platform or App. It is the responsibility of all Users and Talent to ensure that the times allocated to such manual input are correct and to confirm that the times recorded by the crew member are truthful and accurate. In doing so, such Users and Talent confirm that no other confirmation or approval of working times is required.
4.3Failure to comply with clause 4.2 does not waive the terms thereof. Talent Scan will deem all timestamps recorded as truthful and accurate as the time recorded in real time, regardless of whether done by scanning, manual input or any other method of capturing times at any Checkpoint.
5.1The Talent Scan Film Industry ID Card remains the property of Talent Scan Pty Ltd. It is the sole responsibility of the person to whom it is issued to keep it safe and secure.
5.2The Film Industry ID Card may only be used by the person to whom it is issued. No card is transferable or may be used on behalf of another person.
5.3If a Film Industry ID Card is lost or missing, a replacement card will be created and linked to the relevant profile while the missing card is cancelled on the System. A replacement fee of R75.00 is payable before or upon receipt of the replacement card.
6.1Any Talent registering with Talent Scan may add the agents that represent them at the time of registration. Thereafter, agents must request to be added to a Talent's profile upon taking on that Talent as a new client.
6.2A registered Agent will have access to view the profile of any Talent registered under that Agency, as well as Runlists containing such Talent. An Agent may view only the Talent booked on a production's Runlist through their Agency, and may amend specific data for Talent they represent.
7.1Banking details of all Users and Talent are kept secure and encrypted and will only be used for production payroll services and Talent Scan Premium Membership services. Banking details will not be shared with any third party.
7.2It is the responsibility of all Users and Talent to ensure that their banking details are correct and kept up to date in the event of any changes.
8.1Any digital or electronic signature used in conjunction with the Talent Scan System will be stored, as an encrypted file, only for each document that requires a signature. A digital signature will therefore be required for each new document that needs to be signed.
8.2A stored digital or electronic signature will only be used for signing documents associated with the film industry, including but not limited to chit forms, artist release forms, IPAs, timesheets, insurance documents and similar.
8.3By recording or providing a digital or electronic signature on the Talent Scan System in any form, all Users and Talent agree to the terms of use of that signature and grant Talent Scan permission to utilise it for any purpose necessary for the proper functioning of the System, without requiring further confirmation or approval for each use.
8.4By registering on the Platform, signing in on any Runlist on the Platform, or having an Agent load or register them on the Platform, a User or Talent grants official Talent Scan representatives permission to sign (P.P.) any digital document on the Platform on their behalf.
9.1Talent Scan offers a paid Premium Membership tier that provides access to enhanced features of the Platform. The features included in Premium Membership will be communicated within the Platform and may be updated from time to time.
9.2Premium Membership fees are payable in advance and are processed via Talent Scan's designated payment service provider. Subscription and billing terms will be presented at the time of purchase.
9.3Talent Scan reserves the right to change Premium Membership pricing or features with reasonable notice communicated via the Platform.
9.4Cancellation of a Premium Membership will result in the loss of access to premium features. Data and profile information remain on the System in accordance with our Privacy Policy.
10.1Talent Scan awards digital Badges to Talent based on profile milestones, activity and engagement on the Platform. Badges are awarded at Talent Scan's discretion and are not transferable. Talent Scan reserves the right to add, amend or remove badge criteria at any time.
10.2Participation in Community Features — including the community leaderboard and recent activity feed — is entirely opt-in. Users may control their visibility within these features at any time from their profile settings in the App.
10.3By opting in to Community Features, a User consents to their name, profile photo and badge activity being displayed to other registered members of the Platform. Users may opt out at any time, after which their information will no longer appear in the community feed or leaderboard.
10.4Talent Scan does not guarantee the accuracy of the leaderboard ranking at any specific point in time and reserves the right to modify the ranking methodology.
11.1By registering on the Platform, signing in on any Runlist, or having an Agent register them on the Platform, a User grants Talent Scan permission to use their contact details to inform them of new Talent Scan products and services, company news, updates and events. These communications are informative only; work-related communications will be directed through the User's agent.
11.2Users may opt out of marketing communications at any time by following the unsubscribe instructions in any communication or by contacting us. Opting out of marketing communications does not affect the delivery of service-related communications necessary for the operation of the Platform.
12.1All content on the Platform, including but not limited to software, design, text, graphics, logos and the Talent Scan System itself, is the intellectual property of Talent Scan Pty Ltd and may not be reproduced, distributed or used without express written permission.
13.1To the maximum extent permitted by law, Talent Scan shall not be liable for any indirect, incidental or consequential loss or damage arising from the use of or inability to use the Platform, including any loss resulting from offline queuing of data, system downtime, or data inaccuracies provided by Users.
13.2Talent Scan's total liability to any User shall not exceed the amount paid by that User for Premium Membership in the twelve months preceding the event giving rise to the claim.
14.1These Terms and Conditions are governed by the laws of the Republic of South Africa. Any dispute arising from these terms shall be subject to the jurisdiction of the South African courts.
15.1Talent Scan reserves the right to amend these Terms and Conditions at any time. Continued use of the Platform following any amendment constitutes acceptance of the updated terms. Users are encouraged to review this page periodically.
